This legislation regulates electronic signatures and defines their legal validity.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this article, <\/span><b>Al Salamah Law Firm<\/b><span style=\"font-weight: 400;\"> explores how electronic signatures are governed under Saudi law and highlights their key features and legal framework.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>What is an Electronic Signature?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Article 1 of the Electronic Transactions Law defines an electronic signature as:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cElectronic data included in, added to, or logically associated with an electronic transaction used to identify the signatory and indicate their approval of the transaction, as well as to detect any alteration after the signature is applied.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It also defines:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>The \u201csignatory\u201d<\/b><span style=\"font-weight: 400;\"> as a person who signs an electronic transaction using an electronic signature system.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>An \u201celectronic signature system\u201d<\/b><span style=\"font-weight: 400;\"> as a set of electronic data specifically designed to function independently or in conjunction with other electronic data systems to create an electronic signature.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><b>How Are Electronic Signatures Created?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In Saudi Arabia, electronic signatures are validated using a <\/span><b>digital certificate<\/b><span style=\"font-weight: 400;\">, defined as:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cAn electronic document issued by a certification service provider to confirm the identity of the holder of the electronic signature system and to verify the authenticity of their signature.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Certification service providers must be licensed by the <\/span><b>Communications and Information Technology Commission (CITC)<\/b><span style=\"font-weight: 400;\">.
